Here is the Last Will and Testament Kit that we will be getting out to you. Have you ever filled out a will before? WFA. There’s a lot of important pieces so please make sure you are following along.
Article I
This is the Identification of family. Pretty self-explanatory, you would need to put your information on here. (If they do not have a spouse, tell them they need to mark N/A on the line so it doesn’t make the will go null and void).
Article III
This is your disposition of property. Basically everything you own that has a high emotional value or high financial value will be listed here. As an example, anything like family heirlooms, antiques, jewelry you’ll put on here to dispose to a specific individual. From a monetary level, you would list things like your home if you own it, your car, and other expensive things in your house. NOW, (member’s name), this part is super important, you will also list any TFSAs, RRSPs, and insurances, but these life insurances need to be a WHOLE LIFE as TERM insurance or WORK insurance doesn’t stay with you. Do you have any permanent insurance? (If they do, learn if it’s a WL or Term)
This next piece is your Residuary Estate. This is where you will combine all the extras that you have as a total broken down as a percentage for how it’ll be divided up between your loved ones. Super important you ensure all these numbers equal 100%
Article IV, V, VI and VII
This next area is for your personal representative and executor. Do you know what they do? WFA. They basically are the ones in charge to ensure that what you write in your will gets completed properly. You would need to pick someone as your executor and digital executor and they can be the same person if you please.
(The nomination of guardian and pet guardian can be skipped if they don’t have kids under 18 nor pets)
Article X
Now this section is for special directives. This is where you would list if you wanted to do a burial or a cremation or how you wanted your final arrangements to be handled. (Member’s name), have you already taken care of your final arrangements?
Yes - Oh that’s great, were you planning to do a cremation or burial? Has this been paid for already?
No - Oh I understand, it’s something we never want to think about but is necessary when completing a will. Have you thought if you wanted to do a cremation or a burial?
Article XI
This is the self-proving affidavit and how you get this notarized to make this legally binding in the eyes of the court. You can rather go to a lawyer - which will cost more than $500. You can go to a local bank/governing office where they can do it for much cheaper or even for free. And you need to get TWO witnesses to sign off on it but the only rule is these witnesses can’t be in your will to receive anything as this would be a conflict of interest.
